The basics of using Ninth House.

Welcome to Ninth House

These Terms of Service (“Terms”) are an agreement between you and Akshaya Posha LLC, the company that operates Ninth House (“Ninth House”, “we”, “us”). They govern your access to and use of the Ninth House website, apps, and reading services (the “Services”).

By creating an account, making a payment, or using the Services, you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, please do not use the Services.

Ninth House is currently offered as a beta. Features may change, and you may encounter occasional errors or interruptions while we improve the Services.

Who can use Ninth House

You must be at least 18 years old to use the Services and to make payments. By using Ninth House you confirm that you are 18 or older and able to enter into a binding agreement.

You may use the Services only where doing so is permitted by the laws that apply to you.

Your account

You are responsible for the information in your account, for keeping your login credentials secure, and for activity that happens under your account.

Please provide accurate birth details. Readings are generated from the date, time, and place of birth you enter — inaccurate details produce inaccurate readings.

Tell us promptly if you believe someone has accessed your account without permission.

How readings work, and their limits

Ninth House produces interpretive Vedic astrology readings to support reflection and self-understanding. Readings are generated with the help of automated systems, including AI language models, working from your birth details and the questions you ask.

Because readings are interpretive and partly AI-generated, they may contain errors, omissions, or statements that do not fit your situation. We do not guarantee that any reading is accurate, complete, or suitable for any particular purpose. You use and rely on readings at your own discretion and risk.

The Services are provided for entertainment, reflection, and personal insight — not professional advice of any kind.

Not professional advice

Readings are not medical, psychological, legal, financial, or other professional advice, and are not a substitute for a qualified professional. Do not make significant decisions based solely on a reading. If you have concerns about your health, finances, legal situation, or wellbeing, please consult an appropriately qualified professional.

Payments, balance, and refunds

Ninth House is pay-as-you-go. You start with a small balance, pay only for what you use, and can top up any amount. Your balance and account do not expire.

Prices and the cost of individual readings or features may change. Payments are processed by our payment provider, Stripe; by paying, you also agree to Stripe’s terms.

Completed readings are generally non-refundable, because each reading is generated and delivered to you as soon as you request it.

You may request a refund of any unused prepaid balance by contacting us. If you are a consumer in a jurisdiction that gives you statutory cancellation or withdrawal rights, those rights still apply; by starting a reading you ask us to begin immediately and acknowledge that this may end any applicable withdrawal period for that reading.

Acceptable use

Use Ninth House for your own reflection and lawful personal use. You agree not to:

• Resell, redistribute, or commercially exploit the Services or your readings.
• Copy, scrape, or harvest content, or access the Services through automated means except as we expressly allow.
• Reverse-engineer, decompile, or attempt to extract source code or underlying models.
• Interfere with, overload, or attempt to gain unauthorized access to the Services or other users’ accounts.
• Enter another person’s birth details unless you have their consent to do so.
• Use the Services to break the law or to harm, harass, or impersonate others.

Intellectual property

The Services — including the software, interpretive framework, text, design, and branding — are owned by Akshaya Posha LLC or our licensors and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services and your readings for your own non-commercial use.

The birth details and questions you provide remain yours. You grant us the license needed to process them to generate your readings, operate your account, and keep the Services secure and working, as described in our Privacy Policy. We do not use your birth details, questions, or readings to train AI models, and we do not permit our AI provider to train its models on your data.

The data you provide

To use Ninth House you give us personal information, including birth details. You confirm that any details you enter are yours, or that you have permission to provide them.

Availability and changes to the Services

We work to keep the Services available, but we do not guarantee uninterrupted or error-free operation. We may add, change, suspend, or remove features at any time, particularly during beta.

Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that readings will be accurate or that the Services will meet your expectations.

Limitation of liability

To the fullest extent permitted by law, Ninth House and its officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on a reading or your inability to use the Services.

To the fullest extent permitted by law, our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the three months before the event giving rise to the claim, or US $50.

Some jurisdictions do not allow certain limitations, so parts of the above may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to indemnify and hold Ninth House and its officers, directors, employees, and agents harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of another person’s rights — for example, entering someone else’s birth details without their consent.

Suspension and termination

You can stop using Ninth House at any time. We may suspend or end your access if you break these Terms, misuse the Services, or where we are required to by law. If we end your access for a reason other than misuse, you may request a refund of any unused balance.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.

Before bringing any formal claim, you agree to first email us at hello@ninthhouse.app and give us 30 days to try to resolve the issue informally. Any dispute that cannot be resolved this way will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to that jurisdiction and venue.

General terms

If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part is limited or removed only to the smallest extent necessary.

These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and Akshaya Posha LLC about the Services, and replace any earlier agreements or understandings.

You may not transfer or assign these Terms or your account. We may assign these Terms to a successor in connection with a merger, acquisition, financing, or sale of assets.

If we do not enforce a provision of these Terms on one occasion, that is not a waiver of our right to enforce it later.

We are not responsible for any failure or delay caused by events beyond our reasonable control, including outages of third-party AI or infrastructure providers, network failures, natural events, or government action.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will note them and update the “Last updated” date shown at the top of this page. Your continued use of the Services after changes take effect means you accept the updated Terms.
